RookStack, L.L.C., an Indiana company, on its own behalf, and on behalf of each its subsidiaries (collectively, “RookStack,” “we,” “us,” or “our”) is committed to protecting and respecting the privacy of our users and customers. The RookStack Global Privacy Policy governs our collection of personal information via our websites, tools, applications and other commercial relationships. It includes commitments around the purposes for which we may collect this information, the conditions under which we may share it, the rights and choices of the data subject, and measures taken to protect it.

 

We have developed this privacy policy (the “Policy”) to provide you with information on how we collect personal information from you, including what we do and do not do with it, and what your rights are with respect to such personal information provided to us. This Policy may be amended, from time to time.

 

This Policy applies to information we collect on and through our websites, software services and online tools including but not limited to RookStack.com, SizeMyHVAC.com and others (“Website” or collectively, “Websites”) as well as offline (e.g., through consulting or research activities).

 

RookStack is a data controller with regard to personal information that we collect, derive or obtain about you.

 

 

 

B. WHAT DATA DO WE COLLECT?

 

RookStack collects personally identifiable information, such as your e-mail address, name, or home address. You are under no obligation to provide such information. However, if you do not provide such information, we make no guarantee that we can provide you with services.

 

There is also information about your computer hardware and software that is automatically collected by RookStack. This information can include: your IP address, browser type, access times and referring Web site addresses. This information is used by RookStack for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the RookStack Websites.

 

We may also collect personal information about you through indirect means, for example through third party public sources such as property characteristics webservices.

 

Some data that we collect may not uniquely or specifically identify you but can be used to profile you as a user based on your interests, usage, habits and practices on our Websites. For example, information about the frequency of visits to our Websites and your usage of them (or that can be—like location data based on IP address—derived) from them.

We will obtain your consent to send you direct marketing emails where we are required to do so. Note that you can withdraw your consent at any time by following the instructions in the email on how to unsubscribe. Withdrawing your consent does not make any processing of data that occurred before you withdrew consent unlawful. Additionally, you should be aware that we may still contact you in a non-marketing context related to enforcement of any contracts, license agreements, terms of use, terms of service or other instruments.

 

 

 

D. HOW & WHEN WILL WE SHARE PERSONAL DATA WITH THIRD PARTIES

 

We do not sell, rent, or lease our customer lists to third parties. We occasionally hire other third parties to provide services on our behalf. Third parties that we work with must maintain the confidentiality of any personal information processed by them and are prohibited from using it for any purpose other than to deliver the services.

 

Some of our products and services are co-branded and offered in conjunction with products developed by other third-party companies. This may occur, for example, where software that we develop is sold by a third party in a package with their own software that complements ours. We may share with those third parties such personal information collected in conjunction with the co-branded products and services.

 

In addition, we may share your personal information with:

 

  • Companies that RookStack plans to merge with or be acquired by. If such a transaction takes place, we will require that the new combined entity, or the acquiring entity, follow this Policy or one at least as stringent in terms of the rights and protections provided to you with respect to your personal information. If your personal information is intended to be used contrary to this Policy, you will receive prior notice and the opportunity to communicate preferences you may have, as applicable.
  • Companies that RookStack partners with for co-marketing events and campaigns (e.g. co-hosted events such as webinars, podcasts, or similar events offered by RookStack and a 3rd party partner). These Companies are provided with limited personal information only related to attendance or registration for a specific campaign or event.
  • Law enforcement, government officials, or other third parties (i) if RookStack is compelled to do so by law, such as under a subpoena or court order, (ii) when it is necessary to do so to comply with applicable laws, (iii) where the disclosure of personal information is reasonably necessary to prevent physical harm or financial loss, (iv) to report suspected illegal activity, (v) to investigate violations of any contracts, license agreements, terms of use, terms of service or other instruments, or (vi) as otherwise required by law.

 

 

 

E. HOW WILL WE KEEP (RETAIN) YOUR PERSONAL DATA?

 

We will only retain data for as long as is necessary and in accordance with our data retention procedures. We will retain your personal information if you are a customer for as long as is needed to manage any account held with us and as long as is necessary to enforce terms represented in any contracts, license agreements, terms of use, terms of service or other instruments.

 

We will retain your personal information if you are a prospective customer (for example, if you contacted us about our Websites or services) or have subscribed to any of our marketing communications unless you request otherwise (as described under “Your privacy rights” below).

RookStack operates entirely out of the United States of America (USA). All of our computing resources are located within the USA. The data we collect from you is stored and processed in the USA.

 

We take appropriate steps to ensure that the personal data we collect under this Policy is processed according to the provisions of this Policy and the requirements of applicable law no matter where the data is stored.

A “cookie” is a data file that can be created and stored on your computer or when you visit certain websites. Our Websites may use cookies to store information on your computer. We may also use cookies supplied by your browser or by third party add-ins, such as Flash or Google Analytics. RookStack complies with CCPA. Residents of California have the right to request how we, or a third party affiliated with us, use personal information and request erasure of all personal contact information as stipulated by CCPA or CALOPPA. CCPA stipulates that California residents have the:

 

  • The right to know which personal information is being collected
  • The right to know if personal data is being sold or shared, and to whom
  • The right to object to the sale or sharing of personal data
  • The right to access one’s own personal information
  • The right to correct one’s own personal information
  • The right to limit use and disclosure of sensitive personal information
  • The right to equal service and price, even for consumers who exercise their privacy rights

We may update this Policy to reflect changes to our information practices. When we make changes to this Policy, we will revise the “Last Updated” date at the top.
